Miss-Vw 2 Posted July 29, 2010 Report Share Posted July 29, 2010 Hi allIm in a bit of sh*tty situation at the moment, and its my first time of dealing with something like this so just after a bit of help really. I received a letter from the police yesterday saying that I had been caught doing 97mph on the M4 in a temporary 50mph speed zone. Yeah. Sh*t lol. This is going to be my first speeding offense and Im worried sick about what's going to happen - purely because this has happened before my drivers license had reached 2 years. I passed my test on July 18th 2008 and I was caught speeding on July 4th. I dont know how many points im going to get, but if they throw 6 at me, then im pretty much stuffed right? It happened at 5:07am on a sunday, no one was on the motorway - clear stretch of road, and to be honest, I did see the 50mph 'roadwork' signs, but there were none actually taking place as far as I could see! Im not denying that I was speeding, Im just wondering whether the time of day is actually going to go in my favour considering I wasnt really endangering anyone else but myself? As I say this is my first offense so again, I dont know whether that will go in my favour. I want to join the police force aswell and obviously all that will be put on hold if I get 4 or more points From your personal experiences (if any), any guesses on how bad Im gonna get it from the courts? My dad said just to plead guilty by post before it gets taken further and to just accept what they give me. Im just really, really worried. Link to post Share on other sites
VR6Nat 9 Posted July 29, 2010 Report Share Posted July 29, 2010 the temp 50 signs are in place because of roakworks, which usually are done overnight on a motorway so i doubt the time of you speeding will really help you to be honest.There is a chance you may be offered to do a driving course as its your first offence which is a couple of hundred quid and takes 1-2 days, then you wont get the points, but they might not offer it as you were speeding by such a large amount, even if the 50 signs werent in place you were speeding by a lot. As your dad said, best bet is to plead guilty and take what comes your way, do the driving course if your offered it and if not you'll have to take what comes, unfortunately if you chose to speed you have to accept the risk of being caught, its harsh, but also for a reason, doing 80 in a 70 is one thing, but 97 in a 50 is another.... hopefully you wont lose your licence but if you do take it as a hard lesson learnt. At least that way it can only be as bad or better than you think.As Nat has said you MIGHT get the offer of the driving course but at 97, in a 50, within 2yrs of driving...chance are slimmer than a slim kid on a diet of slim fast.I really wouldnt be suprised if you lose your license tbh as a lad in work got caught doing 92 in a 70 and looking at a minimum of 6 points.Also even though there was no actually work being carried out the speed limit is there to protect the workforce. Therefore the courts wont give a flying monkeys that there was no workers on at that point. Same as parking in a yellow zig zag zone thing outside a school out of school hours, u still get a f*cking lol!Of course this is all worse case scenario and hopefully you wont get hit too bad but whatever comes try and take it on the chin and learn from it Link to post Share on other sites

Only thing that you can try is plead that you need you driving licence for work and get employer to back you up and hopefully they may just give you 5 points and a huge fine.But I do fear you will lose your licence.Think of it as a learning experience about speeding, I'm not saying I don't speed as I do, regularly.I actually went by a van at side if the road at 80 when I'd picked my R32 up but have heard nothing so am lucky Link to post Share on other sites

gavinvr6 0 Posted July 29, 2010 Report Share Posted July 29, 2010 my bro got done doing 68 in a 40. he took a letter from work saying loss of liscence equals loss of job and they gave him the 6 points but didnt ban him.if your work are willing to do that get it then plead stupidity to the judge and tell him your an idiot and you regret doing it. dont try arguing the road was clear and the weather conditions were good or anything like that, dont try to justify your speed or he'll just tear you a new arsehole. basically throw yourself at his mercy and beg. it's probably your only option to be honestit should be 30mph over the limit is 6 points which would equate to a ban in your case, double the posted limit which you were fortunately 2mph under is instant ban no exceptions. goonersteve 0 Posted July 29, 2010 Report Share Posted July 29, 2010 I thought being caught over a certain speed (correct me if i'm wrong, but think it may actually be 97mph) is an automatic ban anyway, regardless of how long you've had license, or which environment you were speeding in? There is also that rule about points being doubled for offences within first two years of getting your license. So all in all, I don't fancy your chances, tbh. Best bet in my opinion, is to plead guilty and try the letter from your employer thing, then keep everything crossed!Hard lesson learned, by sounds of it Link to post Share on other sites

But i did no a really rich lad who got caught at 145mph in a e46 m3. He was being prosecuted for dangerous driving. He spent a lot of money on a very good layer who got BMW to write a letter stating that the e46 m3 is capable of safely handaling 155mph limited and that 145 is well within its limits. The judge had to drop the case as there was not enough evidence against him for dangerous driving and as police didnt do him for speeding he was let off. This is honest altough very rare. My boss did more or less the same thing, it was his first offence and he owns a business so pleaded he needed the car for work. They told him normally it would be a six month ban but as he owned a business they banned him for 2 weeks and made him pay a whopping fine. Link to post Share on other sites
