Basically i am after some advice on behalf of my Dad who seems to have had an unfortunate experience with buying a motor off of eBay.My Dad purchsed a Mitsubishi Shogun on eBay last Sunday 15th May, and paid the full £800 via Paypal straight away. The car was described as spare/repairs as the head gasket had allegedly gone, but the bodywork described as 'As good as you will find'. Anyway, on Saturday my Dad went to collect the car from Kings Lynn with my brother in law with a trailer ready to bring it back, unfortunately this is when things turned sour. When they got there at the agreed Midday time the seller was no where to be seen, although the car was parked outside of his house. They both proceeded to inspect the vehicle in the sellers absence and discovered the vehicle wasn't as described at all as it had numerous dents, bits of trim missing and the fuel tank crushed where it had been jacked up on. My brother in law tried ringing the seller to no avail so text him to advise they were there and wasnt happy with the condition of the car. The seller then called back and was aggresive on the phone stating that he would 'Cut their heads off' if they tried contacting him again. Following this conversation obviously they both left the property in case the seller returned and came home to resolve once everything had calmed down. The only problem now is that following numerous phone calls and emails the seller will not make any contact back so is still holding on to the £800 paid for the car - which we dont have, and is taking no steps at all in coming to a resolution. The problem he now has is that he cannot open any form of dispute via eBay or Paypal as Vehicles are not covered, so where do we stand and what can we do? jims13 6 Posted May 24, 2011 Report Share Posted May 24, 2011 so, did you purchase it through ebay ? or privately after viewing on ebay .if its the latter then ebay wont help ..the police should get involved if you can prove you have paid him 800 pounds for goods not yet recieved , that is theft . although its probaly perceived as a civil matter , so you would have to go through the small claims court . which although easy to do , dont mean you will get any money . hvr6 88 Posted May 24, 2011 Report Share Posted May 24, 2011 just log dispute through paypal saying item not received and you should be able to get your money back asap, they will hold £800 from the sellers paypal account until the dispute is settled, you can escalate through paypal at any time during the claim if you get no response or threats and paypal should be on your side and refund you directly, get this in their system asap so you dont run out of time. Unfortunately Payapl or eBay will not allow you to log a dispute as the buying of Vehicles is not covered, it wont let you forward with a claim online at all but following going to sleep last night i sent this eBay message to the seller:'Dear WayneI have attempted to contact you to no avail, both via email and telephone. As previously advised the item you have sold to my father was not as described - if fact no mention of dents etc in the advert at all and therefore i feel you have not only broken the law with miss advertising but also broken eBay sellers rules/guidelines. Upon collection on the vehicle you wasnt at home, and therefore was unable to discuss these issues with you at the time leaving no option but to leave your property and return home. To date you are unlawfully holding £800 of our money which is classed as theft. Please note that if no contact has been made by yourself or no refund of £800 paid back to our Paypal account by tomorrow i will be contacting the Police to take over these issues for me. Please for a speedy resolution either contact me via return or phone/text me on 07590 204251.Kind RegardsDavid Hanagan'and i have just got a response from him. I honestly appreciate and understand where your coming from as dont get me wrong i want the full £800 back but 24/48 hrs ago i wasnt getting anything back at all so i am grateful for £752. I am sure the police do a great job, but i dont have 100% faith in the justice system and it is likely that i will have to take it through a small claims court which could be never ending.Dont get me wrong this whole thing sucks as it isnt our fault at all and i think its a poor show from eBay and Paypal not covering us at all!
