jezmoz 0 Posted June 8, 2005 Report Share Posted June 8, 2005 someone has just run into the back of me (whilst i was in stationary traffic, hand brake on) and put a right big dent in my new and freshly painted tailgate and scratched my freshly painted spolier. I took pics with my phone, his was worse to be honest. I've got his name, addy, phone no. and car reg plate no. He didn't have his insurance details on him, but seemed like he wanted to avoid insurance. I'm gonna take it to VW tomorrow for an estimate. How does it work , i'm pretty new too driving. Will i get a courtesy car whilst it's fixed? Talk about incovienience! What happens if he says he's not paying?? Link to post Share on other sites

You have technically commited an offence by not reporting an accident on the Queens Highway.If you were confident that he was at fault you would have also had the backup of the feds if it came to any dispute.Sorry for the bad news fella. Your a bit screwed if he disputes it with you mate.P.S If you have any third party witnesses you may be ok i.e a memer of the public or other driver who wasn't in your car that saw the accident and can back you up. Imagine if everyone reported every minor accident, the police would never have time for anything else! If you were stationary in traffic, with handbrake on it can't possibly be your fault. You have done everything right, the camera pictures will help too. Contact the guy, if he wants to avoid insurance, that's up to you really, just get a quote first from VW and make sure he's prepared to pay their prices, not offer you a feeble Link to post Share on other sites
MrBen 0 Posted June 8, 2005 Report Share Posted June 8, 2005 Andy's right, there's no need to report a non-injury accident to Police, unless an involved party drives off without stopping.If he is willing to pay for the repairs and a courtesy car whilst yours is off the road, then that's fine if you want to go down that route. But you are equally able to just put this in the hands of your Insurers. If you are Comprehensively insured, your Insurers will repair your car, usually provide a courtesy car whilst it's done, and then go after the other party for the costs, either from him direct if he wants to, or via his insurers (presuming he is insured). If you are not Comprehensive, you are likely to have 'Uninsured Loss Recovery' or 'Legal Protection insurance', which will effectively do the same thing, but claiming direct from him rather than paying first and claiming later - hence it can be a bit slower.PM or email me if you need any help - I've been in the Insurance game a long time!! If they do say its a write off ask your ins comapny if you can use a body shop of your choice. they may say yes, but wont guarantee the workmanship - but if you know a good bodyshop that wont be a problem. Also seriously consider your no claims bonus - it can make a big difference if you loose 1 year on a group 17 car - thats assuming you have bene driving long enough to get any NCB.Had a simialr experience when i owned a Mk2 Golf - would have been a wrtie off if id gone thru insurance - ended up sorting it myself. jaysVR6 2 Posted June 11, 2005 Report Share Posted June 11, 2005 Accidents are a bloody nightmare and Insurance companies always benifit - business is business (quote me happy my arse!!)I got hit up the arse a few years ago in my RST by a dosy bird who was on her mobile, I didn't see too much damage but wanted her to pay for paint all the same, so I took her details and gave her a call the next day and she agreed to come round and sort things out. When she arrived, she came armed with her MASSIVE tatooed, skin head boyfriend and his mate who both looked like the fookin Chilli Peppers!They basically intimidated me and when I showed them the crease she'd put in my floor they said I'd done it with a hammer!I was screwed, they now knew where my car was kept and basically told me to FUCK OFF and DIE!I'm very suspicious when it come to accidents and it's someone elses fault.
