They sacked me :@ I had been there 11mths and 23days, i took it to my solicitor AND if you have not been employed for 12MTH'S you aint got a leg to stand on ! +o( I lost my career my job/bird/house/car and full use of my right hand! and only got £20k compensation +o( So tread carefully ! and make sure you have a written copy of ALL info including phone calls/conversations/expenses/dates/times etc.. antera309 3 Posted July 26, 2006 Report Share Posted July 26, 2006 An employer can sack you for anything they like in the first 12 months (it doesn't matter if it's 11 months, 30 days, 23 hours and 59 minutes) and the employee cannot take legal action for unfair dismissal. This is a completely different thing to the "probationary period" (usually 3 or 6 months) stated in peoples' contracts.However, I am not sure where the law stands on sacking people while signed off sick. You might want to check this with Citizen's advice."Breach of contract" might be another route to compensation. Although contracts are usually worded very carefully to avoid this, sometimes people make mistakes and leave loopholes in there which can be used by the employee.Best of luck getting this sorted out! mike 6 Posted July 26, 2006 Report Share Posted July 26, 2006 Iv heard they have changed the law and CAN actually sack you on the sick now even with a sick note. dunno if thats true.i was on the sick for 9 weeks recently with bad back and have managed to keep my job, altho they did hint at sacking me.
